Acceptable Use Policy

Please print and read the ITClick Acceptable Use Policy carefully ("AUP" or "Agreement"). This policy governs your use of the services provided by ITClick Solutions Limited (hereinafter referred to as "ITClick"), including Internet access, e-mail and other information, communication and transaction services (collectively called the "ITClick Services" or Services).

By completing the enrolment process to become a subscriber of the Services or by using any of the Services or any software provided by ITClick ("Software") other than to read this AUP, you agree to accept the terms specified herein as if you had signed it. Each time you use the applicable Service reaffirms your acceptance of the then-current Agreement. If you do not wish to be bound by this policy, you may discontinue using the Services and the Software and immediately terminate your account with ITClick.

Goals
The AUP ensures the responsible use of the ITClick network and its resources; preserves the privacy and security of ITClick and our customers' networks; and, seeks to avoid practices which degrade the usability of the ITClick network. The AUP protects the image and reputation of ITClick as a responsible service provider by addressing security, reliability, and the privacy of ITClick's systems and network.

Basis for Acceptable Use
ITClick provides Internet bandwidth and hosting services for its customers. Other than for its own uses, ITClick produces no content for transit across its network. ITClick serves its customers by providing Internet access for the transmission of information. We require that when you, our customer, agree to purchase Service from us, you will use our Service legally and responsibly. The intent of this policy is to make clear certain uses which are inconsistent with our Acceptable Use Policy and not to exhaustively enumerate all such possible uses acceptable or not. You accept the primary responsibility to decide whether any particular use is acceptable. In return for your legal and responsible use of our Service, ITClick will not review, censure, or limit the use of your Service in any way.

Lawful Usage
ITClick’s Internet Services may only be used for lawful purposes. Transmission of any material that is deemed in violation of any international, federal and state regulation either at the sender’s, recipient’s or ITClick’s site is prohibited. This includes copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret. Unlawful access of anyone’s computer system or network is prohibited. ITClick cooperates fully with all enforcement officials investigating unlawful behavior on our network. Anyone who publishes materials and information which are accessible through ITClick’s network is solely responsible for the content of such materials and information and is solely responsible to know and comply with all laws applicable to the publication and distribution of such materials and information.

ITClick does not accept responsibility for the content of the materials and information published by others which is accessible through the ITClick network and does not accept responsibility for the violation of any laws resulting from such publication or distribution. We exercise no control over the content of the information passing through our network; we only provide access. You must take responsibility for your actions on the network and those networks you access through us. Generally, conduct that violates law, regulation, or the accepted norms of the Internet community, whether or not expressly mentioned in this AUP, is prohibited. ITClick reserves the right at all times to prohibit activities that damage its commercial reputation and goodwill.

Each ITClick customer is responsible for the activities of its customer base/representatives or end-users and, by accepting service from ITClick, is agreeing to ensure that its customers/representatives or end-users abide by this AUP. Complaints about customers/representatives or end-users of ITClick customer will be reviewed by ITClick for action. If violations of ITClick’s AUP occur, ITClick reserves the right to terminate services or take action to stop the offending customer from violating ITClick's AUP as ITClick deems appropriate, without notice.

Security Breaches / Denial of Service

Any "denial of service" attack, any attempt to breach authentication or security measures, any release of a virus or worm, or any unauthorized attempt to gain access to any other account, host, or network is prohibited.

Obtaining or attempting to obtain service by any means or device with intent to avoid payment is prohibited.

Unauthorized access, alteration, destruction, or any attempt thereof, of any information of any ITClick customers or end-users by any means or device is prohibited.

These infractions will result in immediate service termination, which may be without notice.

E-mail and Usenet News

Using any ITClick IP address to send duplicative, unsolicited e-mail messages (commercial or otherwise), or to collect the responses from unsolicited e-mail (for example, by maintaining a spamvertised Web site), is prohibited.

ITClick reserves the right in its sole discretion to determine whether duplicative or mass e-mail messages are "unsolicited." A complaint from the recipient is presumptive evidence that the message was unsolicited. ITClick has no obligation to refer complaints to the sender or to identify complaining parties.

Conduct that directly or indirectly encourages, permits, or relies on spamming is included in this prohibition. Examples include failure to implement technical or administrative measures to prevent mass unsolicited e-mail, or providing spam "support services" such as e-mail drop boxes or sales of spamware. Commercial messages that are appropriate under the charter of a newsgroup or mailing list, or that are expressly solicited by the recipients, are permitted.

Harassment or Illegal Activity

Conduct in connection with e-mail, Usenet news, or any other ITClick service that is an obvious nuisance (such as "mail bombing" or falsifying authorship) or that would be unlawful in other contexts (for example, threats, harassment, defamation, obscenity, distribution or possession of child pornography, or software piracy) is prohibited.

Open Mail Relays

Maintaining an open mail relay invites senders of mass unsolicited commercial e-mail to exploit the server by using it for spamming. Failure or refusal to take appropriate steps to close an open mail relay on ITClick's network is grounds for temporary suspension or permanent termination of service at ITClick’s discretion.

Forgery of Identity

Falsifying addressing information or otherwise modifying headers to conceal the sender's or recipient's identity, for the purpose of circumventing this AUP, is prohibited. This provision is not intended to disallow the use of aliases or anonymous remailers for any legitimate purpose.

Copyright, Privacy, and Intellectual Property

Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Pursuant to this AUP, ITClick will terminate, in appropriate circumstances, customers who are repeat infringers.

This prohibition includes publishing a private e-mail message to third parties, by any means, without the express prior consent of the author.

Cooperation with Other Providers

Using ITClick's facilities to engage in activities that violate the Terms of Service of any other network access provider is prohibited. For example, sending unsolicited commercial e-mail through ITClick's facilities to the subscribers of any Internet or online service provider that disallows unsolicited commercial e-mail is prohibited.

Consequences of Violation
ITClick is solely responsible for determining if an unacceptable use has occurred. Even though ITClick does not review or censor materials and information which are accessible on ITClick’s network or other networks which may be connected to ITClick’s network, if ITClick becomes aware that its customer is in violation of the law or this Acceptable Use Policy or any other policy stated here in, or at our web site, ITClick reserves the right to suspend or terminate Service without notice. No advice or statement from an employee of ITClick shall imply or express a warranty or guarantee of any kind, no advice or statement from an employee of ITClick, shall change or imply a change or amendment to this Acceptable Use Policy
Generally, when ITClick learns of unacceptable use, ITClick will notify the party responsible who is then expected to take immediate remedial action to come back into compliance with ITClick’s Acceptable Use Policy. We expect to be notified of the actions taken in order to regain compliance. Every effort will be made to inform the customer prior to any disconnection, and every effort will be made to re-establish the connection as soon as we have an agreement to cease unacceptable use. Evidence of illegal or prohibited activities may be disclosed to law enforcement authorities.
In case of repeated violations of the Acceptable Use Policy, ITClick will permanently terminate Service to the customer and all deposits and fees will be forfeited.

Modification

ITClick reserves the right to add, delete, or modify any provision of this AUP at any time without notice; such changes will be effective immediately upon transmission of notice by e-mail, postal mail, posting on the ITClick Web site or any other means.
